Your trust is very important to us. This means the ±«Óãtv is committed to protecting the privacy and security of your personal data. It is important that you read this privacy notice so that you are aware of how and why we use your personal data. This notice describes how we collect and use personal data about you during and after your relationship with us, in accordance with data protection law.

Why does the ±«Óãtv need to collect my personal data?

When you interact with ±«Óãtv Network radio stations, the data we collect includes personal details like your name, your location, your telephone number, and may include the views, opinions or personal stories you wish to share with us. You can get in touch with us by phone, email or social media.

We will use your personal data to get in touch with you should we need further information about what you’ve sent us.

If you appear on-air, this may include the programme being streamed online and/or available on demand, and your contribution may be used again in a future broadcast. We may use your on-air appearance for promotional purposes on the ±«Óãtv’s social media sites. Broadcast material, which may, for example contain your voice recording or a reference to your name is retained in the ±«Óãtv Archives for historical record purposes.

What personal data will the ±«Óãtv collect?

Depending on your interaction with the ±«Óãtv, we may collect and process the following personal data about you:

• Your name
• Contact details (e.g. phone number, email address, social media account name)
• Location
• Your views, opinions, and any biographical information you choose to share
• A broadcast recording of your voice if you appear on-air

Depending on the nature of the programme you participate in and what you choose to share with the ±«Óãtv, we may also collect the following special category data about you, such as:

• Health information
• Sexual orientation
• Religious or philosophical beliefs
• Political opinions
• Trade union membership

Who is the Data Controller?

The ±«Óãtv is the “data controller” of your personal data. This means that the ±«Óãtv decides what your personal data is used for, and the ways in which it is processed. Your personal data will only be collected and processed for the purposes set out in this privacy notice. As the data controller, the ±«Óãtv has the responsibility to comply with, and to demonstrate compliance with, data protection law.

Contributions and communications sent to the ±«Óãtv through other third-party social media services, third-party messaging services such as WhatsApp, or email are also subject to the terms of conditions and privacy policies of the service you choose to use. You should refer to their privacy policies for how they process your data and their individual retention policies.

Lawful basis for processing your personal data

The lawful basis under which the ±«Óãtv processes your personal data is the performance of its task in the public interest. The ±«Óãtv’s role is to act in the public interest and to serve all audiences with content which informs, educates and entertains. This is in line with its public purpose commitment to, “accurately and authentically represent and portray the lives of the people of the United Kingdom today and raise awareness of the different cultures and alternative viewpoints that make up its society”.

The additional condition under which the ±«Óãtv processes any special category data is substantial public interest and we rely on Schedule 1, Paragraph 13 of the Data Protection Act 2018 related to ‘Journalism, academia, art and literature’.

We also have a legal obligation to retain personal data for regulatory and compliance purposes.

Sharing your personal data

The ±«Óãtv works with approved third-parties who help us to provide some of our services. These partners only use your personal data on behalf of the ±«Óãtv and not independently of the ±«Óãtv. We may share personal data with a third party where required or permitted to do so by law.

Retaining your personal data

If you feature in a ±«Óãtv broadcast or in associated content, this contribution will be retained and archived in perpetuity. Except for where a show or programme website specifies otherwise, we will keep your personal data for up to one (1) year for phone calls and emails, six (6) months for WhatsApp messages; ninety (90) days for social media messages and two (2) years for text messages.

Your personal data will be stored in the UK and the European Economic Area (EEA).

Your rights and more information

You have rights under data protection law:

• You can request a copy of the personal data the ±«Óãtv holds about you.
• You have the right to request that we rectify any inaccurate or incomplete personal data that we hold about you.
• You have the right to ask for the personal data we collect about you to be deleted, however there are limitations and exceptions to this right which may entitle the ±«Óãtv to refuse your request.
• In certain circumstances you have the right to restrict the processing of your personal data, or to object to the processing of your personal data.
• You have the right to ask that we transfer the personal data to you or to another organisation in certain circumstances.
