Privacy statement

Your trust is very important to us. This means the ±«Óãtv is committed to protecting the privacy and security of your personal data. It is important that you read this notice so that you are aware of how and why we are using such information. This privacy notice describes how we collect and use personal data about you during and after your relationship with us, in accordance with data protection law.

Why are we doing this and how can you participate?

To celebrate Scotland’s men team qualifying for the Euros we’re looking for videos of fans celebrating the night they qualified last November. Whether it’s watching that famous penalty save or the post-game dance about the living room we’d love to hear from you.

The videos will be shown across ±«Óãtv platforms, on TV and our social media channels throughout June to promote the ±«Óãtv’s coverage of Scotland matches. Our social media channels include Facebook, Instagram and Twitter.

The ±«Óãtv production team will collect your personal data for the purposes of showing the people of Scotland celebrating qualifying for the Euros. The ±«Óãtv production team will collect your personal data via the ±«Óãtv’s uploader which is an online platform. If we broadcast your contribution, this may include your video being made available online and/or on demand, and your contribution may be used again in a future broadcast.

What will ±«Óãtv collect and how will we use it?

The ±«Óãtv will collect and process the personal data that you have provided to us about yourself. There are two types of data that we may process: personal data and special category data. Special category data is still personal data, but its processing by the ±«Óãtv requires the ±«Óãtv to follow additional compliance steps.

You must be 18 years or older to submit a video. The ±«Óãtv will collect and process the following personal data about you:

  • Your name
  • Your email
  • Your celebration video

You must only submit a video of a group if you have the permission of everyone in the group. Do not submit videos with children under 18 as these will not be used[LW1] .

It is possible the ±«Óãtv will also collect and process special category data which may be inferred from your/others’ image/video. This might include for example:

  • Health related data
  • Race or ethnicity data
  • Religious or philosophical beliefs

Who is the Data Controller?

The ±«Óãtv is the “data controller” of your personal data. This means that the ±«Óãtv decides what your personal data is used for, and the ways in which it is processed. For the avoidance of doubt, your personal data will be collected and processed solely for the purposes set out in this privacy notice. As the data controller, the ±«Óãtv has the responsibility to comply, and to demonstrate compliance with, data protection law.

Lawful basis for processing your personal data

The legal basis on which the ±«Óãtv processes your personal data is public task. Where we process special category data, this will be on the legal basis of substantial public interest. The ±«Óãtv’s role is to act in the public interest and to serve all audiences with content which informs, educates and entertains, and to reflect the United Kingdom and its cultures and values to the world.

Sharing your data

The ±«Óãtv works with our approved third-party providers who help us to provide some of our services. These partners only use your personal data on behalf of the ±«Óãtv and not independently of the ±«Óãtv and have entered into an appropriate contract meaning they cannot do anything with your personal data unless we have instructed them to do so. We currently use a third-party data storage provider to store your data collected through the uploader form.

We will not share your personal data with other third parties unless required or permitted by law.

Retaining your data

We hope to use your video as part of Your Celebrations, but we can’t guarantee it.

For contributions that are not used, videos and personal data will be deleted after two months from the date of upload.

For contributions that are used, we will store your contact details for up to nine months after upload for editorial reasons, after which it will be deleted. Contributions which are broadcast, such as videos and voice recordings, are retained indefinitely in alignment with the ±«Óãtv’s Archiving Policy.

Your personal data will be stored within the UK and EEA.

Your rights and more information

You have rights under data protection law. You can request a copy of the personal data ±«Óãtv stores about you.

You have the right to ask for the personal data we collect about you to be deleted however there are limitations and exceptions to this right which may entitle the ±«Óãtv to refuse your request.

In certain circumstances, you have the right to restrict the processing of your personal data or to object to the processing of your personal data.

You have the right to ask that we transfer the personal data to you or to another organisation, in certain circumstances.

Updating this privacy notice

We will revise the privacy notice if there are significant changes to how we use your personal data.
